sir,
I have the honour to acknowledge Your Excel-
-lency's letter of 11th. September, informing me that the
Secretary of State after perusing the correspondence which had
been forwarded to him in connexion with Mr. Ho Tung's proposed
three months' tenancy of the "Eyrie", he approved the action of
the Governor in Executive Council; but that the Secretary of
State gave no reasons for such approval. I have also to acknow-
-ledge Your Excellency's letter of 29th. September (received
2nd. October) answering a question which had asked in con-
-nexion with the same subject.

A constitutional question of considerable
importance underlies the action taken by Your Excellency in
Executive Council in this matter, which affects the rights of
civil servants, and I had hoped that it would not be necessary
to raise it. I should not however be justified in not doing so,
and I have therefore prepared a memorandum on the subject,
which I have the honour to request may be laid before the
Secretary of State personally. It may be however that Your
Excellency would wish to submit this new aspect of the question
to the Executive Council before forwarding it to the Secretary
of State.
